Khulu' is a divorce by redemption. The talak is requested by the wife and is granted by the husband upon the wife's paying him a sum of money or an amount in kind, the quantum of which is assessed by the Court in accordance with the means of the parties. A wife who seeks a divorce by redemption does so usually because she is not comfortable with a variety of factors relating to her husband.
The following are some of the factors leading to khulu':
- Concern on the part of both parties of their inability to comply with the laws of Allah.
- Concern on the wife's part about her being unable to be obedient to her husband.
- Concern on the husband's part about his having to use force on his wife because she does not listen to him.
Khulu' can be determined only before a Judge subject to the couple satisfying all the conditions at the time of application for divorce.
