A. Trial Calculations - Procedure


Trial calculations are provided solely for the information of users, to enable them to work out the division of estates of both deceased and living persons. Users may make copies of the calculations. However, it is to be noted that no individual, authority or court of law is obliged to recognise the calculations.
 

The procedure is as follows:

  1. Click 'Trial Calculation' on the menu. The screen will show an on-line form in which particulars of the person whose estate is to be divided are to be entered. The user must indicate the gender of the person.


  2. After completing the form, click 'Submit' to proceed.
    The user is prompted to select the rightful beneficiaries to the deceased person’s estate and their number.

    The beneficiaries are Waris Fardu and Waris Asobah. As a pre-condition, the user must abide by the provisions of the Islamic law pertaining to inheritance and barriers to inheritance of estate.

    There are three conditions governing inheritance in Islam:
    • Death of muwaris (one who dies leaving an estate)
    • Existence of beneficiaries at the time of death of muwaris
    • Existence of connection between beneficiaries and muwaris (direct descendants, blood relations).

    Persons who are not related to a deceased person by descent or through marriage shall not be entitled to inherit the estate of the deceased. They are the deceased’s:
     

    • stepchild/stepchilren, stepmother, stepfather
    • adoptive child/adoptive children, adoptive mother, adoptive father
    • in-laws.

    Persons having no right of inheritance:

    • murderers
    • slaves (no longer existent today)
    • those professing any religion other than Islam.
       
  3. Click "NEXT"

    The user is prompted to name the beneficiaries. The user may look at the sample entries in the form for the purpose of finding out the amount of shares each beneficiary is entitled to.

    Click "Change Number of Inheritors" to change the number of beneficiaries.


  4. Click "NEXT"

    The screen will show the beneficiaries who get no share of the estate due to the existence of waris penghalang (close relatives) or because nothing is left of the estate after it has been distributed among Waris Fardu or Waris Asobah.


  5. Click "NEXT"

    The screen will show the shares distributed among other beneficiaries. The user may copy these by going to Netscape or Internet Explorer.

    For a second attempt, click "Retry".

   B. Online Application for Inheritance Certificate - Procedure

The calculation appearing in the Inheritance Certificate is based on the information on beneficiaries provided by the applicant. The names and the identity card numbers of the beneficiaries must be correct before proceeding to make the application.

The procedure:

  1. Click ‘Online Application for Inheritance Certificate’.

    STEP 1 : UNDERTAKING

    The applicant must provide and enter the mandatory information (marked with *) and MUST be any one of the following:

    Applicant is the:
    1. Beneficiary (a Muslim) to the Estate of the Deceased (a Muslim) or
    2. Law firm, on behalf of the beneficiary or
    3. Consultancy firm / agencies, on behalf of the beneficiary or
    4. The Islamic Religious Council of Singapore (MUIS) or
    5. Court
       
    And the Inheritance Certificate is required for any proceedings relating to the administration or distribution of the estate of a deceased person whose estate is to be distributed according to the Muslim Law.

    Law firms, consultancy firms and agencies are required to submit the Statutory Declaration of the beneficiary, upon collection of the Inheritance Certificate.


  2. Select 'Disagree' or 'Agree' for undertaking.


    STEP 2 : DECEASED DETAILS

  3. Select Deceased identification type and enter his/her identification number.


  4. Click ‘Submit’ to proceed.

    If there is an existing record on the deceased (based on the ID number entered in paragraph 3 above), the applicant will be informed with a listing of ‘ACTIVE CERTIFICATE LISTING’, indicating the ‘CERT Status’ of the record(s).

    Click on the [View Detail] button or on the CERT Number to view the existing record.

    Applicant will be given the option to make a ‘Request for Variation / Amendment’.

    Applicants are encouraged to click on [View Detail] button for the details before clicking on ‘Request for Variation/Amendment’.

    In every Inheritance certificate record, applicant may apply for ‘Request for Cert Extract’.

    If there is no record, the applicant will be prompted to enter the particulars of the deceased and the applicant in this form on the screen.

    The ‘Relationship with the deceased’ dropdown option is active only if ‘Beneficiary’ is selected under the Category of Applicant. While the Consulting/Law Firm or Agency field is only active if ‘Consulting/Law Firm or Agency’ category is selected. Both fields would not active if other than the above two categories is selected.


    STEP 3 : INHERITORS DETAILS

  5. The applicant has to select the Male and Female Inheritors (beneficiaries), Muslims only by their relationship with the deceased (NOT with the applicant) and their number(s). Click ‘Next’ to proceed.

    The applicant has to enter the Male and Female Inheritors (beneficiaries) particulars. The name as appear in NRIC or Birth Certificate and the identification numbers of the beneficiaries are necessary; the applicant has to fill in the spaces provided.

    The beneficiaries are Waris Fardu and Waris Asobah. As a pre-condition, the applicant must abide by the provisions of the Islamic law pertaining to inheritance and barriers to inheritance of estate.

  6. To change the number of beneficiaries, use the "Change Number of Inheritors/Previous” button and change as required.

    OR

    Click ‘Submit’ to proceed.


  7. The screen will show the beneficiaries who get no share of the estate due to the existence of “waris penghalang” (close relatives) or because nothing is left of the estate after it has been distributed among Waris Fardu or Waris Asobah.

    This screen would be skipped if there is no beneficiaries’ not getting any shares of the estate.

    Click ‘Next’.


  8. REQUEST FOR CERTIFICATE

    The screen will show the Rejected members and Members who are entitled to shares in the estate and the number of shares that each inheritor is entitled to, and those who get no share of the estate (if any).

    To make an application, click 'Request For Certificate'. Click 'Previous' to go back and edit.


  9. A pop-up box will appear and applicant is about to confirm that the details in this page is correct and proceeding with this application for Inheritance Certificate.


  10. Click Ok to proceed or Cancel to go back to this page.


    CONFIRMATION OF APPLICATION


  11. Upon clicking 'Ok' the screen shows that the application has been received. The applicant is given a reference number, e.g. 12/2007

    Please print and produce this acknowledgement and pay the amount appeared on this screen (using Nets or Cash card only) at the time of collection with the following original documents, with copies of:
    1. Proof of death of the deceased (e.g. Death Certificate)
    2. Applicant’s (beneficiary’s) relationship with the deceased. (e.g. Birth certificate, marriage certificate, etc.).
    3. Statutory Declaration

    Syariah Court only accepts statutory declaration made at this Court by self-applying individual not including law firm or agency.

    An additional fee is applicable for this service (refer to the amount indicated in the acknowledgement page).

    This collection can only be made after 3 working days, during office hours only, at the following address:

    If you are authorizing another person to collect the Inheritance Certificate, an authorization letter and the applicant's identity card must be produced along with the above documentation upon collection.

    This application will be rejected if no payment is received within 14 days from the date of this on-line application. This application would then be void, and a fresh application has to be made thereafter.

   C. Request for Cert Extract - Procedure

An application for Request for Cert Extract can only be made for certificates that are already on the Syariah Court record.

Procedure:

  1. Click ‘Request for Cert Extract’ on the menu.

    Applicant needs to fill the ‘Search’ space in the on-line form and select the appropriate keyword to search for the Inheritance Certificate applied for.

    Click ‘Next’.


  2. If there is no record of the deceased, applicant will be notified accordingly and will have the option to make an ‘Online Application for Inheritance Certificate’. (Please refer to Online Application for Inheritance Certificate Procedure).

    If a record exists, applicant will be able to view it and to ascertain that the record is that of the certificate applied for.

    Applicant can then view the record by clicking the [View Detail] button or CERT number.


  3. Applicant will also be able to view the Inheritance Certificate in detail.

    Click ‘Request for Cert Extract’.


  4. Upon clicking the ‘Request for Cert Extract’, applicant will see the on-line form of Particulars of Applicant. All spaces in the form must be filled.

    Click ‘Next’.


  5. The message on the screen shows that the application has been received. The applicant is given a reference number.

    Please pay the amount shown on the screen. Payment may be made by NETS or cashcard. The applicant must come personally at the Syariah Court during office hours. The address is as follows:
