| Mut'ah is a consolatory gift payable to the ex-wife upon divorce under Section 52(3)(b) of AMLA. |

| Mut'ah can be in the form of clothes, property or money commensurate to the position and capability of the ex-husband. Islam does not fix the sum of Mut'ah - it depends on the consensus of both parties. However, if parties cannot agree on the sum, then the Syariah Court will decide on the sum based on the financial ability of the ex-husband and circumstances of the ex-wife. |

| In Islam, the principles of Mut'ah are: |

- A wife normally depends on the husband for a living. Therefore, if there is payment of Mut'ah, the ex-wife can use that money to begin a new independent life post-divorce.
- To avoid public negative perceptions on the ex-wife. Normally, the public would assume that the wife has some personal defects leading to the divorce. Payment of Mut'ah will avoid such misconceptions.
- To ensure that the divorce proceedings are conducted in the right spirit and as a symbol of appreciation for the ex-wife’s sacrifices and contribution to the family.
